Letselschadevergoeding: waar heeft u recht op?
If you have suffered injury caused by another person, you are entitled to compensation.
Deze vergoeding bestaat niet uit één bedrag, maar uit een optelsom van verschillende schadeposten die samen uw letselschade vergoeding vormen.
Hoe hoog die vergoeding precies is, hangt af van uw specifieke situatie. Geen twee letselschadezaken zijn hetzelfde. Welke schadeposten tellen mee, en hoe wordt de hoogte van uw letselschade vergoeding vastgesteld?
Hoe lang heeft u de tijd om schadevergoeding te claimen?
De hoofdregel is dat u tot vijf jaar nadat u bekend werd met uw schade en de veroorzaker daarvan, een letselschadevergoeding kunt opeisen. Bij een verkeersongeval geldt voor uw vordering op de WAM-verzekeraar in principe een termijn van drie jaar na de datum van het ongeval.
Soms kan een kortere termijn gelden. Wacht daarom niet te lang met het inwinnen van juridisch advies; zo voorkomt u dat uw letselschadevergoeding is verjaard voordat u deze heeft geclaimd.
Hoe stelt de verzekeraar uw schade vast?
Meestal is de wederpartij voor aansprakelijkheid verzekerd en handelt de verzekeraar uw schadevergoeding af. Om uw schade vast te stellen, vergelijkt de verzekeraar uw situatie vóór en na het incident.

Welke schadeposten vallen onder uw letselschade vergoeding?
De letselschadevergoeding is opgebouwd uit verschillende schadeposten. Het totale bedrag hangt af van de ernst van uw letsel, het verloop van uw herstel, de gevolgen voor uw werk of huishouden en de kosten die u daadwerkelijk maakt.
Common damage items are:
- compensation for pain and suffering
- domestic help
- loss of self-efficacy
- loss of income / loss of earning capacity
- income from undeclared work
- disability for self-employed persons
- economic vulnerability
- study delay or backlog
- daily allowance for hospital admission
- medical expenses
- transportation costs
- tools
- moving expenses

Some items of damage are less obvious, but the insurer must still compensate them. Examples include:
- loss of company car
- childcare costs
- costs pedicure/manicure
- additional hairdressing costs
- additional vacation expenses
- additional energy costs
- additional costs for food (pre-packaged vegetables)

Your personal injury lawyer will list all items of damage in a damage overview. This is called astatement of damages.
To substantiate the damages, as much supporting documentation as possible is required, including invoices, quotations, pay slips, etc.
Damage that will occur in the future is also taken into account. This usually happens in the final phase of your personal injury case. First, it must be clear what injuries you have and how these will develop in the future.

Compensation for pain and suffering is compensation for mental damage and reduced quality of life due to, for example, long hospital stays, no longer being able to pursue your hobbies and sports, no longer being able to do volunteer work, or no longer being able to travel. These are just a few examples.
The amount of compensation depends on your injury and recovery, but your age, for example, may also be taken into account.

Wordt uw letselschade vergoeding in één keer uitgekeerd?
De meeste letselschadezaken worden afgekocht met een afkoopsom. Dit betekent dat u in één keer de totale schadevergoeding, ook voor de toekomst, krijgt uitgekeerd.
The lump sum payment takes into account all opportunities and risks, such as the chance that you may become unable to work in the future due to a worsening of your symptoms.
If it is too risky to settle the personal injury case definitively, you can also request a reservation. This allows you to receive higher compensation at a later date if your symptoms worsen and the damage increases as a result.
Moet u belasting betalen over uw schadevergoeding?
The insurer pays out the personal injury compensation net. This means you do not have to pay income tax on it.
However, you must declare your assets and therefore also the compensation in Box 3 for capital gains tax purposes. This can be taken into account when determining the amount of compensation.
Soms maakt de Belastingdienst hierin toch een fout, waardoor onterecht inkomstenbelasting wordt geheven over uw schadevergoeding. Vraag daarom bij de afhandeling van uw zaak om een belastinggarantie. Met deze garantie lost de verzekeraar een eventueel probleem met de Belastingdienst voor u op.
